Terms of Service

Welcome to Rising Factor. These Terms govern your use of our web design and maintenance services. By engaging our services, you agree to these terms. We operate from Niagara, Ontario, serving local businesses with AI-maintained "Living Websites."

What We Provide

We provide web design, development, and ongoing maintenance ("Living Website" subscription). This includes hosting, security updates, content adjustments via our AI tools, and AODA-aligned accessibility features. We do not guarantee specific search engine rankings or sales figures.

Artificial Intelligence Disclosure

Our "Living Website" platform uses AI to maintain your site, generate content drafts, and optimize performance. Your data is processed securely to improve your site's functionality. We do not use client data to train public AI models. You retain full ownership of your website content and assets.

Subscription & Billing

Services are billed monthly via subscription. Fees are due on the first of each month. Late payments may result in service suspension after a 7-day grace period. We reserve the right to adjust pricing with 30 days' notice, subject to contract terms.

Your Obligations

You agree to provide accurate content and timely feedback. You are responsible for ensuring all text and images you provide do not infringe on third-party rights. We will notify you of critical issues, but you must act promptly to resolve them.

Legal Limitations

Rising Factor's liability is limited to the amount paid in the preceding three months. We are not liable for indirect, incidental, or consequential damages arising from service interruptions or data loss, except where prohibited by law.

Jurisdiction

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes will be resolved in the courts of Niagara Region, Ontario.
